TERMS OF USE - KUVANDE

1. Welcome to Kuvande Online Market Place

Welcome to Kuvande Online Market Place ("Kuvande", "we", "our", "us").

Kuvande is a digital commerce platform that enables Vendors to create online stores, upload products, manage staff accounts, process customer orders, track sales, and grow their businesses online.

These Terms of Use constitute a legally binding agreement between you and Kuvande.

By accessing or using Kuvande, you confirm that you have read, understood, and agreed to be bound by these Terms.

If you do not agree, please discontinue use of the platform immediately.

2. Definitions

  • "Vendor" – A business or individual operating a store on Kuvande.
  • "Vendor Staff" – User accounts created by a Vendor to assist in managing the store.
  • "Customer" – Any individual who browses products or places orders through a Vendor Store or the Kuvande Marketplace.
  • "Platform" – The website, mobile interfaces, tools, and services provided by Kuvande.
  • "Subscription Fee" – Payment required to access full platform features.
  • "Free Plan" – Limited access plan provided by Kuvande at no cost.
  • "KYC" – Know Your Customer verification process.

3. Eligibility to Use Kuvande

By using the platform, you confirm that:

  • You are at least 18 years old
  • You are legally competent to enter into an agreement
  • If registering a business, you are authorized to act on its behalf

Kuvande reserves the right to approve or reject any Vendor or Customer account.

4. Account Registration

Vendors must provide accurate information including:

  • Full name
  • Business/store name
  • Phone number
  • Email
  • Address
  • Store details

Vendors may also create Staff Accounts for employees assisting in store management. Vendors are fully responsible for the actions of their staff.

Providing false or misleading information may result in suspension or deletion of your account.

5. KYC Verification (Optional but Recommended)

Kuvande may request KYC verification to enhance trust and reduce fraud.

KYC may include:

  • Ghana Card number
  • ID images
  • Selfie verification

Kuvande may grant a Verified Badge to Vendors who complete verification successfully.

6. Subscription Plans and Payment Requirements

6.1 Mandatory Subscription for Full Access

Kuvande operates on a subscription model.

A Vendor must have an active, paid subscription to:

  • Process customer orders
  • Record sales
  • Receive checkout transactions
  • Allow customers to complete purchases

Vendors can view all features without an active subscription, but cannot perform sales activities until payment is made.

6.2 Free Subscription Plan

Kuvande provides a Free Limited Plan, which allows:

  • Store creation
  • Product uploads
  • Viewing of all features
  • Dashboard access

However:

customers cannot place orders, and Vendors cannot record sales or activate checkout until a paid subscription is active.

6.3 Subscription Payments

Subscription payments are processed securely through Paystack, a trusted third-party payment provider.

Kuvande does not store payment card details or Mobile Money PINs.

6.4 Subscription Options

Vendors may choose:

  • Monthly
  • 3 Months
  • 6 Months
  • 1 Year
  • 2 Years

All subscription fees must be paid in advance.

7. Vendor Responsibilities

Vendors agree to:

  • Provide accurate product information
  • Ensure product availability before listing
  • Deliver products as promised
  • Maintain good customer service
  • Handle customer complaints professionally
  • Respect and protect customer data
  • Fulfill orders promptly

Vendors are strictly prohibited from:

  • Selling illegal, harmful, or restricted products
  • Using customer data for purposes outside order fulfillment
  • Duplicating or scraping data from other stores
  • Misrepresenting products

Failure to comply may lead to suspension or termination.

8. Vendor Staff Accounts

Vendors may create staff accounts with limited or full permissions.

The Vendor is:

  • Fully liable for all actions of their staff
  • Responsible for removing staff who leave the business
  • Required to manage permissions carefully

Kuvande is not responsible for misuse by Vendor Staff.

9. Customer Responsibilities

Customers agree to:

  • Provide accurate delivery information
  • Pay for orders using accepted methods
  • Not misuse the platform or harass Vendors
  • Not engage in fraud or unauthorized chargebacks

10. Order Processing, Delivery & Payments

Kuvande provides tools for Vendors to manage:

  • Orders
  • Delivery options
  • Sales tracking

Delivery charges are determined by the Vendor.

A Vendor may set Delivery Pricing Rules, and the system will display the applicable delivery fee to the customer during checkout, based on their selected location.

Kuvande is not responsible for:

  • Vendor delivery delays
  • Vendor failure to fulfill orders
  • Product quality complaints
  • Wrong product delivery

Customers must contact the Vendor first.

If unresolved, Kuvande may step in to mediate.

11. Refund and Return Policy

Kuvande does not process refunds directly.

Refunds are handled by the Vendor.

If a customer has an issue:

  1. They must contact the Vendor directly
  2. If unresolved within a reasonable period, they may escalate to Kuvande for investigation

Kuvande may suspend Vendors who repeatedly fail to honor refunds or deliver products.

12. Prohibited Activities

Users may not:

  • Attempt to hack or disrupt Kuvande's systems
  • Upload viruses or harmful scripts
  • Use the platform for money laundering
  • Create fake stores or impersonate businesses
  • Abuse subscription features
  • Engage in fraudulent chargebacks

13. Data Protection & Privacy

Kuvande processes data according to the Kuvande Privacy Policy, which forms part of these Terms.

Users consent to the collection and processing of their data in accordance with the Privacy Policy.

14. Intellectual Property

All:

  • Platform features
  • Designs
  • Logos
  • Trademarks
  • Code
  • Content

are the property of Kuvande Online Market Place.

Vendors may not copy, resell, or replicate platform features.

15. Account Suspension & Termination

Kuvande may suspend or terminate accounts for:

  • Fraudulent activities
  • Repeated customer complaints
  • Violation of these Terms
  • Abuse of the free plan
  • Chargeback fraud
  • Illegal activities

Suspension may be immediate without prior notice.

16. Limitation of Liability

Kuvande is not liable for:

  • Loss of sales
  • Vendor-to-customer disputes
  • Delayed deliveries
  • Product quality issues
  • Payment delays caused by third-party gateways
  • Loss of data due to Vendor negligence
  • Business losses resulting from misuse of the platform

The platform is provided "as is" without warranties of any kind.

17. Changes to These Terms

Kuvande may update these Terms from time to time.

Updates will be posted at www.kuvande.com, with an updated effective date.

Continued use of the platform means you accept the revised Terms.
