MyShop Terms of Service

1. Introduction

Welcome to MyShops, a digital e-commerce and POS platform operated by Skeadak Consult ("we", "our", or "us").

These Terms of Service ("Terms") govern your access to and use of the MyShops platform, including our website, mobile applications, vendor dashboard, and related services (collectively, the "Service").

By creating an account, setting up a store, or using MyShops in any way, you agree to comply with these Terms. If you do not agree, you may not access or use MyShops.

2. Definitions

• "Vendor" — any business or individual who registers to sell products or services on MyShops.
• "Customer" — any person who browses, purchases, or interacts with a Vendor store hosted on MyShops.
• "Platform" — refers to MyShops's digital infrastructure and tools.
• "Account" — your registered access to the MyShops system.

3. Eligibility

To use MyShops:

• You must be at least 18 years old and capable of entering a legally binding agreement.
• You must provide accurate and truthful information during sign-up.
• You must comply with all applicable laws and regulations in Ghana and any region you operate in.

4. Account Registration and Responsibility

Vendors must create an account to access MyShops' features.

You are responsible for:

• Keeping your login credentials secure.
• All activity that occurs under your account.
• Ensuring your store information, pricing, and contact details are accurate and up to date.

If you suspect unauthorized use of your account, notify support@skeadakconsult.com immediately.

5. Use of the Platform

MyShops grants you a limited, non-exclusive, non-transferable license to use the platform for lawful business purposes.

You agree not to:

• Use MyShops for illegal or fraudulent activities.
• Upload or sell prohibited items (weapons, counterfeit goods, adult content, etc.).
• Misrepresent your business, products, or services.
• Interfere with or disrupt the operation of the platform.

Violation of these terms may result in immediate suspension or termination of your account.

6. Subscription and Fees

• MyShops currently offers a subscription-based model for Vendors.
• Subscription fees are non-refundable once paid.
• Prices are subject to change with prior notice.
• Vendors who fail to renew may have their stores deactivated until payment is made.
• All transactions and subscriptions are governed by Ghanaian tax and business laws.

7. Payment Processing

All payments on MyShops are handled through third-party payment gateways, including:

MTN MoMo, Telecel, Vodafone Cash, and Paystack.

• MyShops does not store customer or vendor payment credentials.
• Payments go directly to the Vendor via their chosen gateway.
• Vendors are solely responsible for reconciling their payments and managing refunds.

8. Data Protection and Privacy

Your data and customer data are handled in accordance with the MyShop Privacy Policy, which forms part of these Terms.

By using the platform, you agree to Skeadak Consult's data collection, storage, and processing practices outlined at:

All vendors and customers are bound by Skeadak Consult's data protection standards.

9. Vendor Obligations

By operating a store on MyShops, you agree to:

• Conduct your business ethically and transparently.
• Deliver products or services as advertised.
• Comply with Ghana's Consumer Protection and Data Protection laws.
• Respond promptly to customer inquiries and complaints.
• Keep customer information confidential and use it only for order fulfillment.

Skeadak Consult reserves the right to review or remove stores that violate platform rules or damage brand reputation.

10. Intellectual Property

• All content, trademarks, designs, and software related to MyShops are the property of Skeadak Consult.
• Vendors retain ownership of their own content (product images, descriptions, etc.) but grant Skeadak Consult a non-exclusive license to display and promote it on the platform.
• You may not copy, modify, distribute, or use any MyShops intellectual property without written consent.

11. Suspension and Termination

Skeadak Consult reserves the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse or misuse the platform
• Fail to pay subscription fees
• Failure to deliver item purchased by customers

Upon termination, access to all data and services may be revoked, except where legally required to be retained.

12. Limitation of Liability

To the fullest extent permitted by law, Skeadak Consult is not liable for:

• Any loss of profit, data, or business interruption
• Any issues arising from third-party payment failures or delivery services
• Misuse of customer data by vendors

MyShops is provided "as is," and Skeadak Consult makes no guarantees of uninterrupted service or error-free operation.

13. Indemnification

You agree to indemnify and hold harmless Skeadak Consult, its affiliates, and employees from any claims, damages, or losses arising from:

• Your use of the MyShops platform
• Your violation of these Terms or applicable laws
• Disputes with your customers or payment processors

14. Modifications

• Skeadak Consult may update or modify these Terms periodically.
• Continued use of MyShop after any changes constitutes acceptance of the revised Terms.
• The latest version will always be available on www.myshop.com.

15. Governing Law and Jurisdiction

• These Terms are governed by the laws of Ghana.
• Any disputes shall be resolved under the jurisdiction of the Courts of Ghana.
